This Trade Dress is inherently distinctive and enjoys substantial consumer recognition in the marketplace as identifying BP Climb-Guard® as the sole souce for this printed fencing system. It is non-functional in its totality and in its individual elements.
Any unauthorized copying, imitation, manufacture, sale, or distribution of products that replicate or substantially resemble the BP Climb-Guard® Trade Dress – including “knock-off” or “look-alike” printed fencing systems – constitutes trade dress infringement, unfair competition, and dilution. We will vigorously pursue all available remedies, including injunctive relief, actual damages, disgorgement of profits, treble damages, punitive damages and attorney’s fees.
